Procedure for entering into civil service 

 

The right to hold a position in the civil service is vested in citizens of the Republic of Armenia who meet the requirements set out under the job description for the given civil service position, are fluent in Armenian and have attained the age of 18, irrespective of national origin, race, gender, religion, political or other opinion, social origin, property or other status, except for persons:

  1. declared through judicial procedure as having no or limited active legal capacity;
  2. deprived through judicial procedure of the right to hold a position in the civil service;
  3. suffering from a disease which may — in case of appointment to a position in the civil service — impede the performance of official duties and exercise of powers;
  4. convicted for a crime, and whose conviction is not expunged or quashed in the prescribed manner;
  5. having avoided compulsory fixed-term military service.

 

Procedure for conducting competitions for vacant positions in the civil service 

According to points 9 and 10 of the Annex to the Decision of the Civil Service Council of the Republic of Armenia No 17-N of 13 June 2002  "On establishing the procedure for conducting a competition for a vacant position in the civil service", the preparatory activities of a competition for vacant highest and chief positions in the civil service are carried out by the Staff of the Civil Service Council, and the competition is held by the Competition Commission established as prescribed by the Civil Service Council. The preparatory activities of a competition for vacant leading positions are carried out by the Staff of the Ministry of Justice of the Republic of Armenia, and the competition is held by the Competition Commission established as prescribed by the Ministry of Justice of the Republic of Armenia. In accordance with points 35 and 36 of the Annex to the Decision of the Civil Service Council of the Republic of Armenia No 818-N of 12 October 2010 "On establishing the procedure for conducting testing to grant a certificate for holding a junior position in the civil service and the procedure for holding a vacant junior position in the civil service", within three working days following the expiry of the time period prescribed for accepting documents under the announcement for a vacant junior position, the Head of the Staff of the Ministry of Justice of the Republic of Armenia appoints to junior positions in the civil service one of the citizens, having submitted an application and having a valid certificate, who meets the requirements of the job description for the given vacant junior position.

 

Procedure for submitting applications by citizens for holding vacant positions in the civil service 

According to point 15 of the Annex to the Decision of the Civil Service Council of the Republic of Armenia No 17-N of 13 June 2002 "On establishing the procedure for conducting competition for a vacant position in the civil service", for the purpose of participating in the competition citizens apply to the relevant staff, carrying out preparatory activities of the competition, by submitting a written application addressed to the Commission mentioning the position applied for, as well as copies of the documents that prove the compliance with the requirements set out by the job description for the given vacant position.

 

Results of competitions for vacant positions in the civil service 

According to point 67 of the Annex to the Decision of the Civil Service Council of the Republic of Armenia No 17-N of 13 June 2002 "On establishing the procedure for conducting competition for a vacant position in the civil service", the Competition Commission sends the decision and conclusion with respect to the participant(s) declared a winner in the competition to the official, entitled to appoint to the given position, who appoints — within a period of three days — to the given position one of the participants declared a winner in the competition. Where the competition for a vacant position is deemed to be void or none of the participants is declared a winner in the competition, a new competition is announced.

 

Procedure for appealing the results of competitions for vacant positions in the civil service 

The results of the competition may be appealed in writing by the participant (on the part of his or her results) or member of the Commission. 

The written appeal is considered by the Civil Service Council of the Republic of Armenia. The written appeal must — within an hour following the publication of the competition results — be provided to the staff carrying out the preparatory activities of the competition which, following the receipt thereof, immediately sends it to the Council along with the copies of relevant documents and the materials. 

The Council considers the written appeal within three working days upon its being filed with the Staff of the Council.  When considering the written appeal, the Council examines the answer(s) provided by the participant at the interview stage of the competition and the mark(s) given by the member(s) of the Commission which may be changed by the Council (either lowered or raised). 

The Council publishes the decision(s) on a visible board on the same day upon taking it and immediately sends it to the staff carrying out the preparatory activities of the given competition. The decision(s) of the Council may be appealed through judicial procedure. 

The relations pertaining to appeal of the competition results are regulated in accordance with the Annex to the Decision of the Civil Service Council of the Republic of Armenia No 17-N of 13 June 2002 "On establishing the procedure for conducting competition for a vacant position in the civil service" and with the Decision of the Minister of Justice of the Republic of Armenia No 189-N of 15 May 2003 "On approving the rules of procedure of the Competition Commission conducting competition for a leading position in the civil service and the rules of procedure of the Attestation Commission for civil servants holding leading and junior positions in the civil service".
